Terms & conditions

Amara Communications Co., Ltd. is a 4G data service provider which offers high-speed, high-quality, reliable and value-for-money connections.  It has launched the Ananda (or ‘ananda’ as it appears) brand to provide 4G, 4G+, 4G LTE data services to consumers in Myanmar.
 
This is an agreement between you and us, i.e. Amara Communications Limited and its affiliated group companies. By subscribing and accessing the Ananda services, you agree, as a consumer and customer, to be bound by these General Terms and Conditions of Services (“T&C”) as amended by us from time to time.
 
 
1. Definitions
 
In these T&C, the following words and expressions shall have the following meanings. 
 
  1. We, our or us refers to Amara Communications Co., Ltd. and its affiliated group companies;
  2. You or your refers to you, the customer who applies or subscribes for or utilises any Ananda services;
  3. MSISDN refers to all MSISDNs (telephone numbers) provided to customers by ACS. All MSISDN are the property of ACS and consequently may be altered, changed or withdrawn at any time with notice to you.
  4. Price plan/ Base plan refers to the package of services you have chosen. You can always check this by using the ‘my ananda’ app, by visiting www.ananda.com.mm or by calling us on +959 969 787878. 
  5. Services refer to the data and content services you receive through our network and any other service we may make available to you.    
2. Use of our services
 

2.1 Account and, password and personal information

 
To access our services, you should set up an Ananda account and register with us online through www.ananda.com.mm or seek assistance from our nearest service centres. You must complete the application and information required to activate the account. We will provide you a MSISDN in association with your mobile equipment to access our services. The MSISDN shall remain our property at all times and may be altered, changed or withdrawn at any time by us provided with a notice to you as the registrant. 
 
You should be responsible to keep secure and confidential of your accountpersonal information, password and PIN in order to access to our services, regardless whether they are stored on your personal mobile device or elsewhere, and whether they are accessed by you or a third party under your authorization.  We shall not be responsible for any loss or damages, either direct or indirect, due to leak of your accountpersonal information,  or password or PIN which is not caused by our fault.
 
Notwithstanding the above, you agree and give prior consent that we may use your information to manage your account with us, calculate credit history, carry out customer-care activities as well as any other monitor and report obligations required by the applicable laws, and train our staff for customer services purpose. Such personal information may also include monitoring call, emails or text messages that you communicate with us.
 
2.2 Privacy and personal information
 
In general, we value your privacy and will protect your personal information with reasonable measures, so it is important to us that you understand how we collect and process personal information about you.
 
If you choose to transact with us, i.e. for subscription of any Ananda products and services or use our portal or access equipment, you will be asked to provide your personal information including, without limitation, your name, personal identification card number, photo, phone number and email address. Where you request to access and use Ananda’s products, services or portal for the purposes of making transactions involving online payments, your credit card information may also be collected for the purpose of processing your payments requests.
 
We may be required by law or a government authority to disclose your personal information in some circumstances.  We will only do so if it is permitted or required under the applicable laws.
 
Hereby you agree, acknowledge and give prior consent that: (i) we may collect, use, storage, and process your personal information and data by us or any third party on our behalf; and (ii) your agreement, acknowledgement and consent under this Clause 2.2 is continuing and shall be deemed vested on us at all times as long as you use our products, services, portal and access equipment, and to the extent as permitted by the applicable laws. You may inform us if you wish to change your agreement, acknowledgement and consent under this Clause 2.2, if such notification to us is in accordance with the procedures set out by us from time to time. 
 
Hereby you also warrant that any information provided to us is true, accurate and complete.
 
2.3 Access equipment
 
We will provide you access equipment to access our services. Once you receive that access equipment, it is your sole responsibility to keep and maintain that equipment. However, we shall not be liable for any damage, destruction, theft or loss of the access equipment, nor shall we be liable to refund for costs of that equipment or any services that you have paid in advance, whether such services have been consumed or not. In the event of any damage, destruction, theft or loss of the access equipment, you shall inform us immediately.
 
2.4 Availability of services
 
Our provision of services will be subject to the following conditions:
 
  1. Your choice and subscription of Price plan/Base plan;
  2. Your choice of the equipment type; and
  3. Our network availability at your specific locations at any given time.
 
We will use our best endeavours to provide the necessary information to help customers find out availability of our services to meet their needs. We shall not be responsible and provide no guarantee of service availability if you utilize equipment which is not approved by us or in a location outside our network coverage. Furthermore, the speed of our services and network may vary and be influenced due to multiple factors (which are likely out of our control). In those circumstances, we shall not be responsible to refund of any charges that you paid to us or compensate you in any way due to the unavailability, instability or malfunction of our network. We also reserve the rights to suspend or terminate any services to you, either in whole or in part, at our sole discretion.
 
2.5 Variation of services and prices
 
We reserve the rights to vary, change, suspend or terminate any services subject to this T&C at any time. Such variation of services and T&C shall become effective after a reasonable notice is given to you or published on our website. You agree and hereby give prior consent that you continual use of our services after the variation becomes effective constitute a binding acceptance of the variation by you.  
 
We reserve the right to amend the rates and prices of our services at our sole discretion, which will be updated on our website www.ananda.com.mm.
 
2.6 Service Centre
 
Our service centre acts as a relationship centre and is assigned to assist you with all your needs, including but not limited to providing you with the access equipment, the price-plan/ base-plan of the services, the administration of your account, and handling your queries in relation to the services. 
 
2.7 Taxes
 
Unless stated otherwise, the price of services rendered by us (including but not limited to the data plans purchased by you) are inclusive of Commercial Tax and/or any other Government tax and levies that we are liable to pay in Myanmar.
 
 
3. Customer obligations
 
3.1 Restriction on use of our services
 
You, as a consumer and customer of our services:
  1. must comply with the applicable laws in relation to registration with and access to our services;
  2. shall not resell, transfer or sublet the service for business purposes and/or in violation of any applicable laws;
  3. are solely responsible for the content and security of any data or information which you send or receive using our services;
  4. are solely responsible for any use of the services or any equipment for access to our service;
  5. are solely responsible to contact us, in case the access equipment has been stolen, damaged, destroyed or lost; 
  6. will not, and will ensure that you do not, use or attempt to use our services in a way:
    1. without our due authorisation;
    2. infringing any person’s lawful rights, including any intellectual property rights;
    3. transmitting, publishing or communicating material or content which is illegal, defamatory, offensive, abusive, indecent or menacing;
    4. causing damages, interference or interruption to our services, network or any third party’s network;
    5. with an intent to avoid incurring charges.
 
 
4. Suspension and termination
 
4.1 Access to services, suspension and disconnection
 
Your access to our services could be impacted under the following circumstances:
  • You use access equipment or services contrary to the T&C or, which is not capable of use on LTE TDD 2,600 MHz technology;
  • You do anything or allow anything to be done which we consider may damage or affect the operation, performance or security of the network or the services;
  • Your access to our services is suspected to be gained in an unauthorized, illegal, improper or fraudulent way;
  • You report theft or loss of the access equipment; 
  • Your Ananda account has no transaction activities (e.g. top-up, purchase of any Price plan/Base plan) for a period of 150 days from the expiry of your last Price plan/Base plan (or any other period as we deem fit from time to time);
  • Your Ananda account has low or no credit balance;
  • You become bankrupt or make any arrangement with your creditors or undergoes liquidation or if an administration order is made or a receiver is appointed over any of your assets;
  • Upon expiry of your base plan or low balance of credit in your Ananda account, access speeds and data volume might be restricted at our discretion;
  • Access to websites which are restricted by the Myanmar government authorities;
  • We are required to suspend services to you due to any applicable laws, order or direction from any judicial or government authority, emergency or force majeure event out of our control; or 
  • We are permanently unable to provide the services to you.
 
4.2 Termination 
 
We may suspend (for such period as we may consider appropriate) or terminate any service to you at any time, in circumstances which we deem appropriate with reasonable notice to you.  In the event that you do not adhere to the terms of the T&C in particular Section 3, we may at our discretion terminate or disconnect your access to our services, and may further forfeit the remaining credit (if any) in your Ananda account. 
 
 
5. Our liability and limitation  
 
To the extent permitted by the applicable laws, we shall not be responsible for any loss or damages, either direct or indirect, which are not caused by our negligence or misconduct, including:
 
  • Any loss or damages arising from due to compliance with any applicable laws, order or direction from any judicial or government authority,  
  • Any loss or damages arising from emergency or force majeure event which is not foreseeable by us or out of our control;
  • Any loss or damage that is indirectly or consequential, including loss of income or profit, loss of access to services, loss of data, loss of business opportunities, loss of prospectus revenues, etc. and
  • Any loss or damage that is caused by a third party
Notwithstanding the above, if we are held liable to you for any loss or damages due to use of our services, our liability to you for any loss and damages arising from or in connection with our services to you shall not be more than the services charges we retain from you to provide the particular services which cause such loss or damages. 
 
 
6. Miscellaneous
 
6.1 Intellectual property and other rights 
 
The website www.ananda.com.mm includes our registered trademarks, trademarks that may be subject to pending trademark applications, design and trade name, including by not limited to the word “ananda.” All these intellectual property and other rights shall remain at all times as properties owned by us. 
 
6.2 Severability
 
Should any provision hereof be deemed, for any reason whatsoever, to be invalid or inoperative, such provision shall be deemed severable and shall not affect the force and validity of other provisions of this Agreement.
 
6.3 Waiver
 
No failure to exercise or enforce, and no delay by us in exercising or enforcing our rights under the T&C shall operate as a waiver thereof nor shall such failure or delay in any way prejudice or affect our rights at any time thereafter to enforce our rights and powers under the T&C or any other agreement with you. 
 
6.4 Amendment
 
We may amend, vary or supplement the T&C at our sole discretion, which includes but is not limited to addressing any changes in the services, plan, rates and prices, data protection policy and account use policy which will be updated on the website www.ananda.com.mm or by a notice to you. Your continual access to our services after publication of such amendments shall constitute a binding acceptance by you.
 
6.5 Notice
 
We will provide reasonable notice of these changes to the Customers through messages, emails, publication in any newspaper circulating in Myanmar, or posting on our website or otherwise making public in any other matter deemed appropriate by us, shall be considered good and sufficient notice thereof to you and shall be deemed to have been received by you on the date of such notice, as applicable.

Getting started

ananda offers 5 types of starter packs: (i) ananda mifi pack (ii) ananda mifi+ pack (iii) ananda router pack (iv) ananda router unlimited pack (v) ananda SIM pack

No. Once your starter pack expires, you can choose to continue on an unlimited plan, or you can switch to a value plan which allows you to choose the right number of GBs for you.

Only selected smartphones are directly compatible with the ananda SIM; those with frequency band 38 (the required 2600 MHz frequency) and the TDD LTE platform.) To use your ananda SIM in your smartphone, please 1. Go to mobile network settings 2. Select Access Point Names and select add APN 3. Set APN name and APN as ‘ananda’ 4. You should now be able to enjoy the ananda network on your smartphone.

Once your existing plan is expired, please top up and buy a new base plan (unlimited or value). You will receive a notification on the my ananda app, or via e-mail, or via SMS before your existing plan is due to expire. 6. Select “Apply”, then log out.

Top ups and Usage Checking

You can top up in the following ways: – Visit a store (find your nearest store in the my ananda app) – Buy a top up card at an ananda store or partner retailer – e-top-up at an ananda store Top up online via the my ananda app or the ananda website with – credit card – MPU (MPU card must be registered for ecommerce purchase).

You can check your balance on the home screen of the my ananda app. To install the my ananda app on your smartphone, visit ananda.com.mm/app.

Daily data usage can be check in the my ananda app. Simply click on (more> usage history) to check your usage over the last 7 days.For last 30 days data usage , please contact customer care.

Base plans

If you have sufficient balance at the end of your starter pack’s validity period, your current plan will be automatically renewed if you switch on the auto renew button in my ananda app. Or you can also purchase other base plans on the my ananda app or ananda.com.mm.

Certain value plans have a set of GB data bonuses attached. If you buy a value plan that is eligible for a bonus, the bonus will be added to your balance.

Yes. The remaining allowance will be carried forward, provided you subscribe to another value plan within 7 days of expiry of your previous plan.

We encourage you to wait until your active unlimited plan has expired, or is about to expire, before buying a new value plan to get the best value. If you buy a new value plan before the active unlimited plan expires, your current unlimited plan benefits will be forfeited.

Yes. You can use any network to access the my ananda app. There are no data charges when using the my ananda app on the ananda network.

The following defects are not covered in the device warranty 1. Use of the Product in a manner contrary to instructions of the manual; 2. End-User’s misuse, abuse, negligence or accident; 3. Disassembling or repair without ananda’s prior authorization; 4. Spills of food or liquid, fall, or burning of printed circuit board; 5. Defect or damage arising from force majeure; 6. Normal wear and tear; 7. IMEI/serial number of Product or accessory has been removed or altered; 8. Defect arises out of the warranty period of the Product; 9. Impact damage / screen crack 10. Sun and heat damage

Bring the device to your nearest ananda experience store.

1. Make sure you are connected to the mifi’s Wi-Fi signal. 2. Type http://192.168.1.1 into your browser to go to the device management web interface. 3. Enter “”admin”” as the password.

Log in to the device management web interface > Information > Connected Users

Select ‘restore factory settings’. Alternatively, press and hold the ‘reset’ button, found on the side of the mifi inside the back cover, and the mifi will be restored to default factory settings.

The optimum power adapter to use to charge the ananda mifi is: Input :AC100V-240V ~ 50/60Hz 0.25 A Output : DC5V 1000mA

Devices: Huawei B310 router

The router connects to the ananda 4G+ network via the ananda SIM, and then wirelessly shares this data connection with nearby, Wi-Fi-enabled devices such as laptops, smart phones, tablets etc. Up to 32 devices can connect to the router simultaneously.

Insert ananda SIM card into the SIM card slot and connect the power adapter to the Huawei B310 router. The router will turn on automatically and search for the ananda 4G+ mobile network. Note: Do not insert or remove the SIM card when the router is running, as this may affect the performance or damage the SIM card.

1. Switch on your device (eg. smarphone, laptop) 2. Select the router network name (SSID) from the list of available networks. 3. Enter the password (Wi-Fi key) The network name (SSID) and password (Wi-Fi key) are found on the back of the router.

1. Make sure you are connected to the router’s Wi-Fi signal. 2. Type http://192.168.8.1 into your browser to go to the device management web interface. 3. Enter SSID and password (found on the bottom of the router). 4. Select Settings > WLAN > WLAN Basic Settings > Change SSID and WPA pre-shared key 5. Enter a new name and new password of your choice. 6. Select “Apply”, then log out.

No. The router requires a power adapter as a power source.

Only someone who has the password can connect to your router network. As long as you have enabled your wireless security and set a new password, your hotspot should be secure.

Yes. Both the mifi and router support any ananda SIM.

No. Your router only supports an ananda SIM.

Devices rental

Renting a device is simple. Visit an ananda experience store to enquire about device rental. You will then need to pay a deposit of 55,000 Ks for a router, or 35,000 Ks for a mifi, together with the 35,000 Ks for an unlimited30 plan. The rental contract for a router is 12 months, and for a mifi is 6 months. To rent a device, you must first buy an unlimited30 plan. You can rent a device at all ananda experience stores.

If you don’t want to rent the device anymore, you can return the device and claim the deposit back.

The rental contract duration is 12 months for a router, and 6 months for a mifi.

You can return your device to an ananda experience store, together with all original packaging and accessories.

Please refer to the returns policy to understand whether you are eligible for a full refund: – Get the full deposit back if you return your device within 7 days of purchase – Get the full deposit back if you return your device after the end of the contract period.You must purchase a 30 day plan every month to eligible to get the deposit back. – Refurbishment fee (10,000 Ks for router, 5,000 Ks for mifi) will be deducted from your deposit if you return your device AFTER 7 days, but BEFORE the end of the contract. Please note: the device must be returned with all original packaging and accessories (charger, device & SIM) in good condition or the deposit will be forfeited. Rent to buy: − Buy an unlimited30 plan every month for the duration of your contract and keep your device at the end of the contract period

Router and mifi devices are now available to rent by making a deposit, and signing a contract. The router rental contract is for 12 months, the mifi rental contract is for 6 months. To find out more about device rental, please visit ananda.com.mm/shop/devices

  • If the device is not working during the rental period, you can bring the device to your nearest ananda experience stores where a member of ananda staff will help you.
     

If you return the device before the contract end, you will be charged a refurbishment fee of 10,000 Ks for a router and 5,000 Ks for a mifi.

There is no rental fee to rent the device

Fair usage policy (FUP)

We are committed to ensuring our customers have the best internet experience at affordable prices in the market. To achieve this goal, we provide a contended internet service. This means our Internet bandwidth (capacity) is configured to be shared by all our customers at any one point in time, to ensure we provide a satisfactory and acceptable performance on an equal basis to all our customers. However, a small number of customers use more than their “fair share” of the Internet bandwidth provided by us, using a disproportionate amount of Internet bandwidth. These customers degrade the experience for others by taking bandwidth away from other customers, who use the service fairly. Our Fair Usage Policy is to ensure that all customers are using a fair amount of bandwidth as apportioned fairly for the best experience on our network.
